I’ve been told the law has changed regarding eligibility for funding of care costs. How might this apply to my parents who are in a home at the moment?
Following a Court of Appeal ruling the law now states that if the main or primary reason for the person to go into care was due to their mental or physical health then they may, subject to criteria be eligible for funding. This has arisen because many local authorities who administer care homes have wrongly assessed patients as being ineligible for public funding of their care needs.
Many people have therefore been wrongly charged for their care costs and can reclaim these sums which many run into many tens of thousands of pounds. Claims in excess of £250,000 have been known.
However claims for reassessment need to be lodged very quickly as the Department of Health has set deadlines for requests to be lodged. These are:-
- 01/04/04 – 30/09/07 – deadline for assessment requests 30/09/12
- 01/10/07 – 31/03/11 – deadline for assessment requests 30/09/12
- 01/04/11 – 31/03/12 – deadline for assessment requests 31/03/13
