Davis v Scroggin is a case where a biker was filtering past a long line of traffic and an American tourist who had obviously got bored performed a u-turn directly in front of him without looking and that case was decided 100% in favour of Mr Davis so that gives us heart really as bike accident lawyers to say that we can get good compensation even in a filtering case. So don’t give in if you have had negative advice, call me and I will be happy to advise you on it, it does take very very detailed analysis of the evidence so as I say don’t give up don’t accept the first offer and get professional advice.

Read my full reply here, or listen to my iTunes podcast where I fully answer this question.

If you would like further advice, you can email me directly at info@lampkinco.co.uk. You can also follow me on twitter @compensateme.

Yes. If you have an accident case running with solicitors and you have lost confidence in them and they can’t restore that confidence, you can consider moving your case. You always have the right to choose your own legal representation, despite the fact that insurance companies always insist that you have to use their panel solicitors (this has been outlawed following a European Court ruling).

Your new solicitors will get you to sign an authority allowing the old solicitors to transfer your papers and they will undertake (promise) that upon the eventual conclusion of the case they will make sure the old solicitors get their appropriate share of the costs from the losing party. It’s easy to transfer but choose your new solicitors very carefully otherwise it could be “from frying pan to fire”.
