Fortunately his injuries have turned out to be reasonably short lasting having resolved within two years, however at the time it was suspected he had fractured his spine.

Indeed, he was treated for a spinal fracture at the scene and subsequently although the X-rays taken at the time have been impossible to read.

If the case had boiled down to a two year soft tissue neck injury a maximum award would have been around £4000 but we achieved well in excess of this as our expert medics could show that there was probably some small wedge fracture of a vertebrae.

We obtained expert evidence of his minor but troubling injuries being a deep cut to his knee and lip together with professional photographs showing some scarring. This was used to put the case to the local council who were forced to accept they had breached their duty to maintain the highway.

Remarkably, despite being hit by such a large vehicle, he sustained very few if indeed any physical effects and the case revolved around finding out if he had sustained any brain damage as he was rendered unconcious.

The injuries will give lifelong problems but working life will not be particularly affected. The main thrust of the case however was the involvement of the Motor Insurer’s Bureau and how they tried to defeat the claim at all times.

The Motor Insurer’s Bureau (MIB) is an organisation that is funded by all the motor insurers to fund compensation for any victim of an uninsured or untraced driver.

The agreement has changed many times and contains exclusion clauses and other “get outs”. These are often used by the MIB to avoid making a payment when otherwise it would seem they should.

This is what happened here as they alleged that our pillion rider should have known the rider had no insurance. This seemingly simple point involved a long, expensive and very technical legal battle. If we had lost then our client would have received no compensation for these horrific injuries, but we successfully argued the case.

The client, riding a vintage bike, was involved in a classic “sorry mate didn’t see you” collision. A car driver literally looked but didn’t see and emerged when the bike was level with the front of her car and directly into contact with our client’s knee, causing substantial damage.

The assessment of compensation is always difficult and is to reflect the pain suffering and loss of amenity sustained. In this case the client fortunately made a swift and total recovery and so the award was limited even for what was as nasty fracture.

The case was important though because liability was hard fought. The employers did not want to accept that the yard was defective so we commissioned a full survey report together with photographs which led to a surrender by the insurers.

The client who works in the city has a scooter to nip around and take advantage of the free parking and congestion charges for bikes. Unfortunately as our client was filtering past a line of traffic at reasonable speed and very carefully (as confirmed by witnesses) a van to his left turned to the right and collided with him sending him “flying”.

The recent increase in fuel prices and costs of motoring are leading to an increase in scooter use and these filtering accidents are becomming very common. We are experts at analysing such scenarios and in this case we achieved a 100% award as we carried out a detailled examination of the junction and found that a right turn was actually prohibited there. We believe the van driver was attempting a dangerous U-turn procedure.

The client suffered multiple soft tissue injuries to his neck, shoulder and down to his achillies tendon. His injuries were said to resolve within 20 months post accident. This award is, in our opinion, towards the top of the range for such injuries but more importantly we recovered on a 100% basis in a “filtering” accident which is actually quite rare.

As his car entered the “blind spot” just by the rear offside quarter of the van the driver pulled out quickly to overtake the car in front without indication or warning and into collision with our client’s vehicle giving him no chance.

Liability was quickly established and a medical report obtained showing the client had whiplash type injuries to neck, back and shoulders requiring up to 10 sessions of physiotherapy and a prognosis period of 6-9 months post accident. We secured an award for personal injury compensation of £3000 for this multi-site injury.

This case shows how a quick glance over your right shoulder, a manoeuvre called a “life saver” by bikers is essential before pulling out to overtake just to check there is not a vehicle in your blind spot.

Our client was travelling along a major road in Liverpool when a vehicle failed to give way and struck the nearside of her vehicle causing substantial damage. Fortunately no bones were broken but the she was traumatised by what was a very frightening collision. Pain in her neck and back became worse in the days following the accident and her worry and anxiety also worsened.

Our outgoing client had trouble with travel following the accident needing some sessions of counselling and other help to deal with the intrusive thoughts and to help her overcome her profound travel anxiety.

The examining Doctors thought that both her physical and emotional injuries would resolve within one year from the date of the accident which is quite a common prognosis period. Normally for the physical aspect of this injury some courts would award less so we were delighted when we secured sufficient compensation to properly reflect the trauma aspect suffered by our client which is a component of road traffic injuries that is often overlooked.

A really good result for this client and one that we can use for the benefit of future clients as a point of reference and comparison.
